Extended use of data

Legal Information on Data Collection:

This event is attended by members of federal constitutional bodies, among others. The protection of members of these constitutional bodies of the Federal Government, and in specific cases, guests of these bodies from other countries, is the responsibility of the Federal Criminal Police Office (BKA) pursuant to Section 6(1) sentence 1, no. 1 of the Federal Criminal Police Office Act (BKAG).

According to Section 6(1) sentence 1, no. 2 of the BKAG, the BKA is also responsible for the internal protection  of the respective premises of the Federal President, members of the Federal Government, and, in special cases, their guests from other countries.

To fulfill this statutory protection duty, the BKA collects personal data of individuals who come into the vicinity of the protected persons or enter their residences during the event. The BKA collects this data in order to identify potential sources of danger and take appropriate measures to avert any threats, if necessary.

The authority to collect data is derived from Sections 9(2) and (3) in conjunction with Section 6(1) of the Federal Criminal Police Office Act (BKAG). Accordingly, the BKA may collect personal data insofar as this is necessary to fulfill its protection duties under Section 6 BKAG. The personal data must be collected transparently and directly from the individual concerned. However, it may also be collected from other public or private authorities if it is not possible to obtain the data directly from the data subject, or if doing so would jeopardize or significantly hinder the fulfillment of the Federal Criminal Police Office's tasks as outlined in sentence 1. The authorization standard does not require the data subject's consent for data collection.

Information on Legal Remedies:

An appeal against this decision may be lodged with the organizer within one month of notification. The appeal must be submitted in writing to the Federal Criminal Police Office, 65173 Wiesbaden.
